The Supreme Court said that it’s not just a fancy thing for women to work; it’s a rule in the Constitution. They said this while talking about how important it is for moms with disabled kids to have time off to take care of them. They got really serious about it, saying that not letting these moms take time off violates the Constitution. The court even made sure the government joined in on the discussion. They also told the government to think about giving this leave to a lady who works as a geography teacher in Himachal Pradesh. This all happened because she couldn’t take time off to look after her son, who had been sick since he was born.
The court made a big decision in a case where a geography teacher from Nalagarh, Himachal Pradesh, couldn’t take time off to take care of her sick son because she used up all her leave days.
“We think this is a serious issue. The lady brought up the Rights of Persons with Disabilities Act. The commissioner said they didn’t have a rule for this kind of leave. Women working isn’t just a fancy thing, it’s a rule in the Constitution. The government should know better,” said the Supreme Court.
They also told the state government to change its rules about this kind of leave to match the Rights of Persons with Disabilities Act, 2016. They even set up a committee to figure out what to do about this by the end of July.
“In the end, this case is about what the government should do. The rules they make should match what the Constitution says. Himachal Pradesh needs to rethink how they give this leave to moms with special kids,” said the Chief Justice of India.
Before, the court asked the Himachal Pradesh government and the director of higher education about this case on October 29, 2021. Later, they asked for a response from the commissioner under The Persons with Disabilities Act, 1995.
